With the deepening development of the internet applications, particularly the rapid development of e-commerce, the Internet trademark infringement is increasing in a diverse way. Meanwhile, the traditional way protecting the trademark right encounters unprecedented challenges for the virtuality, super regionality, technological diversity and other characteristics of the network, Therefore, it is necessary to discuss the nature and different presences of trademark infringement against the Internet environment through the traditional theory of trademark infringement and the use of trademarks, to further perfect the existing legal provisions, and to adapt to the needs of the trademark rights protection against the Internet environment. This paper makes an analysis of the use of trademark though the Internet and points out that the basic theory of traditional trademark infringement is also applicable for dealing with internet trademark infringement, then puts forward the recommendations and advices for the administrative supervision improvements using the characteristics and strength of the traditional administrative supervision. as reference.This article is divided into three parts, the first part begins with the basic theory revealing the criteria and the nature of traditional trademark infringement, considering the characteristics of the Internet environment, then points out that internet trademark infringement standards are basically the same with the traditional ones. The second part of the paper, according to the criteria mentioned above, makes an analysis of typical types of the trademark infringement, in particular, the one caused by the conflicts of domain name and trademark, then makes relevant recommendations for legislation and law application. The third part mainly brings forward the recommendations and advices for the industrial and commercial administration departments on how they can give full play to the advantages of administrative supervision, and solve the difficulties when dealing with the trademark infringement under the Internet environment, and improve the efficiency.
