Legislative hearing is the most important way of democratic lawmaking, which is the embodiment of legislation that going through the mass line. The system of legislative hearing has gradually become our an important legal system. Its establishment and implementation has great significance to realize managing state affairs according to law and establish a socialist legal state. In our country, the development of legislative hearing system begins 1980s, which was initially developed in the 1990s. In 2000, the< legislation law> established the legal status of legislative hearing system. Legislative hearing system has become a most important form of the people participating in the national legislation which played an important role to the democratization and scientific of lawmaking in our country., the legislative hearing has become a new system in lawmaking, which has been practiced and growth in nearly ten years, it still exist many problems that need further standardizing and improving.By using the way of study literature and empirical research, this paper analyzes state and local the system of legislative hearing in china from the basic theory of legislative hearing and combines the use of practice of legislative system in other countries. It represents the survey of the legislative hearing system, reveals the actual state and problems of legislative hearing in state and local, and raises the countermeasure of solving the problems. By analyzing and mirroring the system of legislative hearing in other countries, it raises advises to reform and polish local legislative hearing system further.
