National Park In Yunnan Province Legal System

Natural resources are the fundamental basis of economic development. In the past, lacking of concern to the intricate relationships between the natural resources and economic development set the two relationships against each other. While one project is under construction, the surrounding resources and environment will be destroyed for perusing high profit. In the long run, the lost of environmental degradation definitely outweighs the economic development. Therefore, the sustainable economic development should rely on the environmental protection instead of the conventional predatory exploit. In such circumstance, establishing a national park protection system will undoubtedly be a support of the sustainable development of environment protection and economic development.China has a sufficient territory and abundant natural resources. Especially Yunnan province, which is well-known as the kingdom of plants. Within the whole country, Yunnan has the most favorable conditions to build national parks and it has already well prepared. The construction of national park will has various influences on infrastructure construction, forestry, energy construction, tourism and mining industry, and it will reduce the neglecting of environmental effects caused by roads, railways and hydropower stations construction. Besides that, it makes enables the whole society to understand well about the present situation of ecological environment in Yunnan. It also serves an educational purpose, and the tourists will advocate into the activity of environmental protection.On the 10th People's Representative Conference the fifth meeting held on Jan. 28th,2007, "Exploring the establishment of national park environment protection module" was formally included in the Movement Report. This module was clearly mentioned in Yunnan Provincial Government Report 2008 and "Suggestions about protecting north-western bio diversity" brought up after the North-western Bio Diversity Protection Conference held in February,2008. Being approved by Yunnan Provincial Government, Yunnan Forestry Bureau reported that listing Yunnan as trial province of national parks and this report was approved in July,2008. Although Yunnan government is motivating the national park construction, the relevant law and regulation referring to the construction and protection of national parks are totally blank within the whole province and even the whole country at present. This is a tremendous disadvantage in building and managing national park. In order to guarantee the successful processing of the national park construction strategy and achieve the balance of the protection and the development. It is a necessary for us to bear the sustainable strategy, to change our views and to reform the defects. It is important for us to use the successful experience from overseas for reference to establish and consolidate the national park law system. It enables us to effectively protecting national parks and relevant resources and achieving the sustainable economic development.This thesis will use national park law system of Yunnan as the research target. After briefing introduction of the relevant concepts of national park, the article will define the law system. The writer will come up with some suggestions refer to the establishment and perfection of the national park law system based on the analysis results from comparing the law system of some over-sea countries and considering the specific conditions in Yunnan. It is expected to be worth useful proposal n the practical work of establishing national park system in Yunnan afterward.
