China 's Charitable Organizations, Regulatory Legal System Perfect

Charity is a public voluntary and unpaid assistance socially disadvantaged group behavior in general. In addition to market allocation, tax distribution, it is a new distribution methods as a "the third time distribution" to the community, which has an important role in construction of a harmonious society. Because of Government's suboptimal policy, there are too much big problems to supervision of charitable organizations that there have been many charity scandals and charitable corruption. Accordingly, in order to guide and constraint charitable organization behavior, the country needs to perfect the legal system of charity organization supervision. This paper combine the theory of law and sociology by using comparative analysis and other methods, define the relevant conception of charity and introduce the charitable organizations of our regulatory status of the legal system, and finally give some specific recommendations to the supervision of legal mechanisms charitable organizations based on Combining China's actual situation and the advanced experience of Western Europe and America.Addition to the introduction and the concluding remark, this dissertation is divided into four parts:the first part says charitable organization is established, registered with charity whose sole purpose is to non-profit social organization. Laws prevent charitable organization malfunction and effective social control is charitable organization supervision legal system, ensure the existing theories foundation charity stakeholder rights, improve the charity's credibility is the purpose of its existence. The second part respectively expounds Britain and America charitable organization supervision of legal system, and summed up the two countries charitable organization of legal system for the supervision of experience, including security revelation charity organization of independence, a special regulative department, establishing the information openness system and mobilize social aspects of supervision, etc. The third part analyzes charities legal system present situation, the paper mainly points out the charity organization supervision legal system in China, the existing problems of the low level, including legislation without a special laws to regulate the behavior; charity organization "Dual licensing system" admittance system against regulatory information openness system and tax didn't play a corresponding supervision mechanism of function; Charity organization the lack of perfect internal self supervision mechanism. The fourth part charity organization supervision in China, the existing problems of the legal system respectively from the legal system, access system, information disclosure system, tax mechanism and charitable organization set up inside puts forward five perfect recommendations.
