With the reform deepening, institution becomes a central issue for intelligentsia. All subjects of social science carried through all-around discussion and deep research from different angles about institutional function, institutional changing, institutional transferring, institutional innovation and institutional character and so on, coming down to economics, law, culture, sociology, politics and ethnics. This demands us reflect and research the issue of institution on the basis of generalizing the fruits of institutional research, which can provide methodological guidance to the institutional study for all subjects and push the research forward. To explore the issue of institution from philosophical level, a kind of innovative thinking way is to penetrate into the mutual relation between institution and subject from the conception of subject, piercing into the traditional idea and mode and acquire a new horizon.In order to understand the mutual action between subject and institution comprehensively, we should above all lay institution into the horizon of historical materialism, try to begin with analyzing the nature of institution and reveal the dependence and transcendence of subject to institution. Institution is historical, any concrete and realistic institution is in the course of changing and developing; institution is a category of relation developing from relation and is concrete embodiment of social relations; institution is a category of criterion .the basis of social order. Expatiating on subject's development, construction and deconstruction can clear the figuration and restriction for realistic institution to subject. Analysis from the angle of history and logic shows the subjective basis for institution to generate and exist. The historical character of subject and institution have the inherent coherence. According to this ,we review the dialect relation of interaction, mutual influence and impartibility between institution and subject. We can draw a conclusion by analysis that subject's figuration , harmony of inter-subject, restriction and raising of subjectivity are related to institution. On the other hand, subject is not passive, he can select, reconstruct and design institution.Institutional innovation and construction should lay the basis on deep understanding of mutual relation between subject and institution. Institutional construction may lose its way without the fully comprehension and attention whether on theoretical or practical level. On the mutual action of subject and institution, we consider that the direction of institutional construction or the evaluation on certain institution should according as three elements: people-first; balance between order and subject's freedom; harmonizing the relation between subject and object, human and nature and raising the subject's consciousness as species. The ultimate target of institutional construction is to construct harmonious society, promoting complete and free development of subject.
