Study Of The Tang Dynasty Pardon System

The Tang Dynasty is an important time during China history. Lots of political systems in Tang Dynasty are the model for the later Dynasties. But the research of pardon institutional is seldom discussed in history circles. This thesis regards the five types of Tang pardon institutional. Discuss the cause,content,execution and infuence of this institutional. Research this institutional and change of the pardon institutional have the important meaning to the development of China society from six to nine century, and it also has the same meaning to the law institutional. The thesis is divided into four chapters.Chapter I : In this part introduce the origin and development of the pardon institutional before Tang Dynasty and discuss the role of Tang pardon institutional. The first meaning of the pardon is that dismiss and reduce, and the scope of pardon is one person or one thing. Pardon has long history, and it has been developing all the time .In Han dynasty, the pardon institution had more contents and more types .At Shui Dynasty and Tang Dynasty, the pardon institution was mature. More people had criticized the pardon institution in ancient China.Chapter II : Introduce the general situation of the pardon institution. The pardon institution includes five types. The most important type is the big pardon .At the later Tang Dynasty, the content of the big pardon, the deduce pardon and the region pardon were extended. The checks of jail became one of the pardon types. The relationship between the point of the pardon and the extends of Tang pardon institution is very close.Chapter III : Discuss the execution of the pardon institution of Tang Dynasty. At first, besides the judicial organization, the organization of pardon includes other parts. Many factors are related to execution of the pardon institution. They are the deceitful of the content of the book of pardon, the power of emperor, the breaks of officialdom etc .In summary, the content of taxes and the prohibition of bad moral atmosphere are not realistic. It is also difficult to carry out the regulations on the demoted and banished officials. But the reward to the official has been carried out better.Chapter IV: Discuss the effect of the pardon institution from the positive and negative perspectives. The positive point is that it can improve the stability of society, complement the function of law, and promote the development of economy and link between Confucianism and Legalist. After the insurrection of An Shi, the effect of pardon institution was more important than before .The point of negative is that it can make person have mental state by luck, and it can breaks the justice of the law and the regular development of bureaucrat system in Tang Dynasty.
