The Loss Of Farmers' Rights And Interests In Land Transfer

Since the late 80s of last century the rural land circulation had begun in our country and it first appeared in some developed areas along the coast. Now rural land circulation is very common. Especially after the Third Plenary Session of the CPC 17 adopted "the issues which is on rural reform and development advanced by the CPC Central Committee ",the rural land circulation is development lively. In a sense, the rural land circulation gives the perfect conditions which is improve the scale of land use management and efficiency of the land. However, in the process of land circulation has also appeared in a number of negative effects. As the land rights is loss and damaged under the various land circulation mode.Against the loss of land rights in the land circulation, this paper is a rational choice theory as the analytical framework and puts forward two important explanation. Firstly, the peasant does not controlled inadequate "resources", it leads that the peasant limite to get the land rights. The "resource" includes the land rights and the social capital owned by the peasant. Secondly, it is the interests of multi-game and it leads that the peasant limite to achieve the optimal state of society. The stakeholders includes peasant, village collective, local government and land requirements. By the in-depth game analysis, the peasant that no matter which relative interests side is at a disadvantage Game and the result is the loss of peasant rights. Finally, the paper which based on the analysis puts forward suggestions to achieve the protection of peasant rights an interests in land circulation.
