| China has been a members of the World Trade Organization now, as the trades and marketing advancing ,many questions appeared, especially in the area of agriclture antidumping. Agricltrue is primary and basic industry of a country, it is very important in the national economy. Although China is a large agricultural country, but due to the low level of productivity, low technological content, inadequate investment, China's agriculture industry is disadvantaged. China's agriculture market faced a serious impact of imported agricultural products since China joined in WTO. Many agricultural products trade have emerged in the dumping of foreign imports, But it was not until 2006, "the anti-dumping case of potato starch to EU" the only agricultural, products anti-dumping case appearced. The case of agricultural products anti-dumping is so few, it is not because there is no dumpling or dumping is not serious, but caused by a variety of reasons, in this paper, the authors analyzed these issues and put forward corresponding countermeasures.Dumping refers to behavior that the emport products enter the import market which the price lower than the common value. It arising along with economic development. Although dumping have a certain economic development role of exporting and importing countries, but the industry of importing country would damage in the end, so now the most countries make the anti-dumping laws to regulate dumping of imported products. It is necessary to make antidumpling laws. Anti-dumping legislation is divided into international and domestic anti-dumping law, the most important contents of anti-dumping legal system is conditions of the anti-dumping,antidumping measures and antidumping procedures. The present of Anti-dumping investigations must meet three conditions: there are low-priced dumping practices, the consequences of industrial damage, there is a causal relationship between the consequences of dumping and the damage. The application of anti-dumping must through certain procedures.in order to take provisional measures, price undertakings and the anti-dumping duties and other measures.Agricultural products in foreign trade gradually lose the advantages since China joined in WTO, China's agricultural products trade has emerged in the trade deficit, there are varying degrees of dumping in the trade of soybeans, poultry products and cotton trade. The dumping of imported agricultural products suffered from both internal and external causes. Wastern countries with high levels of agricultural productivity, they have advantiges in trades. China must implement comimitments such as tariff reductions, non-tariff measures, it is open the door of import agricltrue porducts ,bun also made impcts of our agricltrue porducts maket. At last introduce the only case of import agricltrue porduct antidumping.There are dumpings in agricultural products trade .but the case of that is only one, why ? There are many reasons. China's anti-dumping legislation is not long, there is a wide range of defects, It is lack of the main application in the enforcement of antidumping law, lack the early warning mechanism. And other reasons, resulted in no antidumping. We must propose countermeasure to the issues raised in the first part, we must strengthen the cultivation of the main application in the enforcement of the law, especially foster agricultural trade associations. Strengthen legislation to make up for all kinds of lack of legal mechanisms, establish early warning, and to make use of WTO rules in favor of the development of the system of agricultural development, promote the competitiveness of China's agricultural products improved. |
