Tourist Scenic Spots, The Legal Regulation Of The Price Adjustment Behavior

As society economy develops, the phenomenon of rising in price in China's tourism scenic spots unexpectedly appeared, which has gravely damaged the public commonality of our society. The main reasons for this phenomenon include the short of relevance laws and statutes in China's tourism scenic spots price control system , the function overlapping in management departments, and the indeterminacy of legal liability ascription. Therefore, our country needs badly to build a set of system in protection and price regulation of tourism scenic spots resource to ensure that price adjustments have laws to go by and come into a legal and normative development, which will make detailed regulation on legislation , the legal authorization of main body of price management, and concrete operating specifications on price management, and so on.Besides of the introduction and the concluding remark, the main body of this paper is divided into three chapters. The first part discusses the fundamental issues concerning the ticket of tourism scenic spots. By defining the nature of tourism scenic spots , this chapter further deduces the nature of tourism scenic spots ticket and the price adjustment, and makes detailed analysises on the above concepts from the perspective of administrative law. The second part mainly analyses the history and actuality of price changes of tourism scenic spots, and the negative impacts which have induced. On basis of the above analysis, this chapter makes a detailed analysis of defects in China's tourism scenic spots ticket price adjustment system from an objective and legal aspects. The third part mainly discusses the legal regulation measures on price of tourism scenic spots, which is the most important part of this paper. In this part, the writer investigated tourism price and management structure of Western countries firstly. On basis of this, the writer suggests that we should adopt foreign laws to improve the shortcomings in our law systems, so we can adopt substantive law and procedural law to regulate the management of China's tourism scenic spots ticket: firstly, makes clear the rights ascription and main body of tourism scenic spots princing; secondly, prescribes the base of price rise of tourism scenic spots and the fund management from an objective view; finally, prescribes the pricing standard, concrete operation norm and hearing procedure of tourism scenic spots ticket.
