| Since"Construction Law"and"Tendering and Bidding Law"being brought into effect in our coutry, tendering and bidding activities of construction was tending regularity gradually, and its policy effect was obvious in preventing corruption, ensuring quality of projects and protecting legitimate rights and interests of the parties involved in tendering and bidding activities. In terms of building market, the practice of tendering and bidding machanism promoting the market to canonical operation as well, but some problems still existed in the prosess of tendering and bidding activity because of distemperedness of supervison machanism, such as evading tendering or public tendering, governing body(including tendering department) took much administrative intervention in construction, and even bogus tendering, getting base price by lawless route and personal prefer in evaluation.This paper takes the supervison machanism in building tendering and bidding as subject. On the basis of using correlative documents and others'experience for reference, we define the concept of building market, tendering and bidding activity and the supervison machanism, and taking the practice of Qingdao Chengyang for example, probe into the status quo and problems which existed in current building tendering and bidding supervision, point out that these problems including law distemperedness, absence of restricting banlance machanism, lack of enough supervision and punishment, rigescence of biding section ploting, and faultiness of expert evaluation machanism, have been fatal obstackle to the effect of tendering and bidding machanism. Contraposing these problems, using quantitative analysis and qualitative analysis as principal research methods and the using system economic and management theory as principal theory, we analyse material causation and design the innovative supervion machanism of building tendering and bidding. Finally, we take practice of Qingdao Chengyang for example to evaluate the performance of innovative supervion machanism.According to the logic, this paper is devided into5 chapters: Chapter 1 is introduction, which is consist of researching background, researching purpose and meanings, researching route and methods. On basis of refering to the document and objectively commenting on the theory and prctice of building tendering and bidding and its supervison, we generalize the important viewpoints, primary theory and principle menthods which can be used for reference in this study and put forward the research framework.Chapter 2 is analysis on the present development and problerms of building tendering and bidding supervison. On the basis of defining building market and the supervison system of tendering and bidding activity, we expound and analyse the history of tendering and bidding supervision and present development, then, we analyse its operating mchanism, finally, we generally analyse the problems and correlative causations.Chapter 3 is construction of innovative supervion machanism of tendering and bidding activity. Aiming at the problems, combining with the practice in Qingdao Chengyang, we construct the new supervison machanism from 8 aspects, which including law system, supervison institution, supervison content, supervison procedure, supervison mode, evaluating mode and supporting of human resource and outlay.Chapter4 is performance evaluation for innovative supervion machanism of tendering and bidding activity. We take practice of Qingdao Chengyang for example, put forward the practical evaluation on base of items which have been up to the reform scheme, and give the theoretic evaluation on base of items which have not been up to the reform scheme.Chapter5 is conclusion, deficiency and prospect of whole paper. We summarize the whole conclusion of study on supervion machanism of tendering and bidding activity, point out the difficulty and some issues which not included or not lucubrated in this paper, and continuous research prospect in the future. |
