Along with the development of socialistic market-orientedeconomy, the third sector gradually emerged in the countryside. But as aresult of the complex multiplicity of rural third sector and the differentdegree of development, it is quite not easy to comprehensively discoursethe rural third sector. The author basing on the "three agriculturalproblems" made every effort to unfold the present situation, the existentquestions and the outlet of the rural third sector from the reasons whythe rural third sector emerged. Under this thinking, the dissertation iscomposed of five parts.Foreword. Mainly expounded the background of the article, thegoal and significance of the research of this subject, the research wayand possible creative idea in this article. The author thought that theconstruction of socialistic new countryside under the condition ofmarket-oriented economy must require government, market, the thirdsector harmoniously coexist. However the third sector in our countrystill was at start stage, therefore it is great significant to studythoroughly.ChapterⅠIntroduction to the third sector. The author started withthe origin of the third sector, then defined the connotation andcharacteristic of it, pointed out the third sector were the organizationswith organization, nongovemment, not seeking profits, autonomy, wishand then based on the administrative jurisprudence research, pointed outthe influence which the third sector study to administrativejurisprudence. Then the author carried on the theory limits to the ruralthird sector, pointed out the rural third sector were all socialorganizations which is spontaneously organized by the farmers or underthe government's impetus and support but the participation were mainlyfarmers. Their goals lied in better realizing farmers' benefits of politics,economy, life and fulfilling social security function. Finally had carriedon the brief comments to some supported concepts. ChapterⅡThe vicissitude of the rural third sector. It is the mosttheoretical part in the article. The author using the historical analysismethod, first reviewed the development course of the rural third sector,and then based on the legal principle and "three agricultural problems"to comment the essential factors of the third sector emerging in thecountryside. The essential factors of legal principle mainly elaboratedtwo aspects: the rule of law of modern public administration;constitutional rights—freedom of association. The essential factors ofinstitution mainly elaborated three aspects: the substitution after thedouble malfunctions of government and market; the gambling betweennation and farmer; the third sector own system superiority. Through theanalysis of these essential factors, the author expounded the necessity ofthe third sector emerging in countryside.ChapterⅢThe rural third sector's main manifestation. The authordiscussed the main manifestation of third sector by positivemethodology. This part of contents be divided into two scraps to carryon the concrete elaboration. First, introduced the traditional rural thirdsector organizations which were the patriarchal clan organization, thesocial charity organization, the public administration organization andthe folk religious organization. Next, in detail elaborated thecontemporary rural third sector organizations which were the thirdsector with culture, the association for the aged, "industrial union", therural association of using water, the rural cooperative medicalorganization, the rural specialized economical association, the rural folkfinance organization, the rural rights protecting organization, the farmerlabor organization.ChapterⅣThe predicament of the rural third sector. This chaptermainly divided into two parts to elaborate. The first part had expoundedthe third sector own insufficiency which displayed in developmentprocess in countryside, mainly in below aspects: the independency is notstrong, the nature is fuzzy; own ability is insufficient; the developmentbetween industries and areas is not balanced, and the total quantity are few; the scale is insufficient. The second part then in detail elaboratedthe exterior hindrance which the rural third sector met, mainly displayedin below aspects: the government reforms is lag; the governmentmanagement is not standard and the rural management is weak; thegovernment's latent limit to third sector; the conflict between the villagebasic unit of political power and rural third sector; the related laws andregulations about the third sector are not perfect. Through to the analysisinside and outside, the author had basically expounded the predicamentwhich the rural third sector met at present.ChapterⅤThe outlet of the rural third sector. This chapter dividedinto two parts to elaborate. The first part mainly elaborated theconstruction questions of the rural third sector: the transformation ofrole of the third sector organization; establish effective movementmechanism with the third sector organization; the third sector's abilityconstruction; the cooperation between the third sector and villagers'autonomous organization. The second part mainly elaborated thesuggestions on policy about the rural third sector: the government'srational assistance; establish benign cooperation relations between therural basic unit of political power and the third sector; consummaterelated laws of the third sector, provide good legal system environment;perfect social supervision mechanism.The author through the elaboration of the five chapters, made everyeffort to unfold the complete picture of the rural third sector and toprovide some experience of the rural third sector development, andwished to better promote the comprehensive development ofcountryside.
