In the era of knowledge economy, intellectual property rights highlight the important and unprecedented position, as the core strategic resources of improving the competitiveness of enterprise or even a state. As the general sense of the works, the state enacted a series of laws and regulations for their protection, but for the folk arts and cultural protection of intellectual property rights,our country have not yet introduced a corresponding laws and regulations, particularly for the folk crafts which are highly vulnerable to imitate.In 2006, the number and value of tourism in Yunnan Province have made a record, reaching more than 7,900 million people, and the output value 49.978 billion Yuan, and the total spending of tourists shopping for 12.5 billion Yuan, while only 158 Yuan per capita consumption. The domestic tourists buy handicrafts per capita tourism spending less than 10 Yuan, overseas visitors and the average only 50Yuan from top to bottom. This reveals that there is still a big problem in Yunnan folk crafts industry, but also has great profit margins. This paper starts with analyzing the elements which constraint the industry of Yunnan folk crafts,from the three main perspectives of government, enterprises and non-governmental organizations,proposing a number of measures and proposals that protect the intellectual property rights of folk crafts in order to promote the development of the industry of Yunnan folk crafts.This paper is through six of the major start to start the study:Introduction is the first part of this paper, which presents a thesis topics background and the significance of topics, the paper's methodology and the main contents of the paper and innovation.The second part is introduction of the folk arts and culture profiles, which include folk arts, cultural connotation and folk arts and culture and the characteristics of the existing protection of intellectual property rights and the difference between the two works big problem. The first issues introduces folk arts and culture some of the most basic characteristics, and the second issue emphasis on the folk crafts with the protection of the property rights of the general works compared with particularity. The third part is only related to the theory of property rights, which constitutes the full text of the theoretical basis, including the protection of intellectual property and its economics perspective analysis of the economic impact, and infringements of intellectual property rights with the economic model, preliminary analysis of China's current widespread violations of intellectual property rights causes.The part fourth through the perspective of brief analysis Yunnan Province's industry of the current folk crafts. Including Yunnan folk crafts briefing, the status quo of the industrialization, the major issues and the need to protect intellectual property rights of folk crafts.Part fifth in the above content on the basis of the relevant measures, the focus is the full text of the content, mainly from enterprises governments and non-governmental organizations of three aspects, a crafts enterprises from all aspects of the value chain to protect the perspective of the Government, mainly from strengthening legislation, law enforcement, and the relevant laws and regulations outreach, and create a sound environment for development and cultivation of talents five folk crafts aspects of protection. In addition, through the perspective of the development of non-governmental organizations to strengthen trade associations and industry self-regulation on the craft of intellectual property rights protection.Chapter sixth made by the main thing is to sum up and prospects.
