| China is in on the historical stage of further reform, environmental problems have been an important incentive for social conflicts. In recent years, with the growing environmental consciousness, public pay an increasing attention on the environmental impact of the events around them, especially economic projects, they begin to seek express of environmental interests. However, due to weak and opaque public participation mechanism, during the expression of the environmental interests, public take some aggressive action, fighting against government, which leads to the outbreak of a series of environmental social conflicts, for example, Shifang event, Panyu waste incineration power generation events.To resolve environmental social conflicts properly and promote social harmony, an effective path is to improve the environment public participation system. Only through broad and robust public participation, institutionalize and legalize the public participation in the environmental protection field can avoid and reduce the environmental social conflicts, overcome the ’Do not put pollutants built in my backyard’(NIMBY) mentality. Public participation is not just mean reporting and supervising the behavior of government and corporate, the more important part is that through behavior participation or participating environmental protection in all aspects of daily life, influence and change public’s life habits, promote the public’s environmental consciousness, make all of the public join this great cause of environmental protection, then the solve environmental problems can be solved fundamentally and the environmental benefits can be realized.The main theorists study public participation from the perspective of the supervising of public to the government, different from it, this article studies public participation from the perspective of public’s own behavior participation and based on the social instability caused by the current environment problems. This article studies the concept of public participation in environmental law system, clarifies that the public participation is not only a right but also an obligation of the public, and analyzes the significance of public participation, especially significance of public participation in environmental protection and solving the current problems. This paper attempts to build a complete system of public participation in environmental law system framework, that is:information disclosure system, as the basis for public participation; the macro, meso and micro public participation system, as the main system; public interest litigation,as the protection. In this paper, the method of comparative analysis is used, to summarize the legislation and practice and analyze the features of public participation in environmental law in developed countries, such as the U.S., Japan and France. This paper cards China’s current legislation and the practice and puts forward recommendations on improving the public participation system in China, such as emphasizing on behavior participation, improving the information disclosure system, especially the product information disclosure system, improving environmental public interest litigation system, making the role of non-governmental organizations in full play. |
