In modern society, democracy, public participation system is an important system to protect the environment. At present, China is gradually build public participation in environmental protection system, but the actual needs of today’s society is beyond the scope of the existing legal system, it is necessary on the basis of the combination of China’s specific national conditions, combined with the characteristics of Chinese society, the beneficial outcomes of learning abroad public participation in environmental protection of the various ways and means to achieve the ultimate aim to improve participation in the system of environmental protection, the path of sustainable development.Our country in recent years to accelerate the development and utilization of historical and cultural heritage, such as Old Summer Palace Ruins appeared big "rectification" action, the relevant authorities in Old Summer Palace lake seepage laying attracted wide public attention. In this paper, "Old Summer Palace lake seepage case" for example, combined with China’s specific national conditions, in order to improve the system of public participation in environmental protection in the title,China’s environmental protection system exists for public participation: the legislative basis for the lack of rights, the public failed to obtain environmental information,public participation in environmental protection narrow range and is involved in an abstract way, the power of NGO’s weak, limited personal remedy the problem. To build public participation in environmental protection institutional system is analyzed,and some thinking to improve public participation in environmental protection system.From the position of environmental information to know, hearing system of environmental rights, public participation in the EIA system of six angles,non-governmental organizations, environmental public interest litigation analysis, and strive to continuously improve our system of public participation in environmental protection.
