The Research Of Administrative Accountability For Food Safety Control System

Recently, the government food regulatory functions become the focus of public attention as food safety incidents and severe food security situations occur frequently, so establishing accountability mechanism for monitoring food safety has become the important part of one of the issues.Administrative accountability of food safety control system means that specific subjects demand all levels of governments and food safety supervisions to bear negative consequences of a norm for leading to the situation of food safety incidents as intentionally or through negligence, default or incorrect statutory duty. Administrative accountability is rooted in popular sovereignty, agency and public choice theory, including the administrative accountability of subjecst, objects, reasons, procedures, means and remedies. If the regulators are not in place, supply and demand are conflict with each other for safety information asymmetry in the food market, the probability of the occurrence of food safety will be increased. The critical approach to make the government to perform its regulatory responsibilities seriously is to build a administrative accountability of food safety control system including accountability subjects, accountability objects, accountability reasons, accountability procedures, accountability results, accountability remedies based on the theories and elements.From the perspective of the legislative and institutional analysis for China's current food safety supervision, the supervision of food safety control in concepts, contents, structures, responsibilities and distributions of various accountability are clearly defined, but the measures for administrative accountability in food safety control have some weaknesses. From the analysis of "Sanlu milk powder incident", the existing main problems show that inadequate accountability subjects, unclear definition of accountability objects, narrow range for accountability reasons, lack standardized accountability procedures, lack accountability mechanism of remedies. Therefore, our administrative accountability of food safety control system can be improved by broading the variant form of accountability through legal means, determining the objects of accountability through rationally dividing the party and government relations, expanding the scope of accountability reasons, standardized accountability procedures, uniting accountability of results and responsibilities, clearing remedy channels for accountability of officials.
