Study On Time Claims Under The Influence Of Cross-delayed Events

Whether the owners and contractors don't want to see this phenomenon, Because the construction can't be put into use on time, the owners'economic operations is slowed down, the profit chance is reduced, so it will bring a certain degree of economic losses to owners. Meanwhile, the construction delay reduces the production efficiency of the construction labor, increases the input costs of more resources such as labor, materials, machines, and adds the management expenses. Therefore, Time Claims has become to be an effective mechanism to solve this problem.With the international projects continuously increase, Time Claims is gradually accepted and applied. Among them, Time claims caused by the cross events which is due to the construction division refinement and construction procedure specialization exists widely as a special manifestation, and it becomes to be a subject that scholars and engineering professionals study and discuss. Reasonably solving this kind of problem involving the responsibility distributing principle and the calculation of delay time becomes to be an difficulty in Time Claims.According to the present situation analysis of Time Claims for cross-delayed events in China and abroad, this paper puts forward problems existing in the engineering construction:the unfairness of the responsibility distributing principles and the difficulty of time claims calculation. The research thinking of this paper is based on the study of the related references, combining with the requirements of contract conditions of FIDIC and construction project building contract (criterion paper) in 1999, contrasting the existing principle, puts forward a reasonable responsibility distributing principle which is more suitable for our national circumstances and the legal spirit. According to the comparison of time claims calculation methods at home and abroad and the discussion on allocation of the Float Time, this paper puts forward a "influence proportion calculation" based on TIA Method. The concrete contents include the following parts:The first part is an introduction. It proposed the necessity of the research on Time Claims. Through studying on reference at home and broad, it finds those current problems existing in this subject, then comes up with a solution and method.The second part is the analysis on the current status of Time Claims. Through the fundamental summary of Time Claim, we can get hold of the necessary condition and basic program for the establishment of Time Claims. Through analyzing the current situation of Time Claims, we can find out the common cause of the delay event, and classify them, contrast them. we also can propose the attentions of processing procedure. Through analyzing the practical operation, we can find the difficulty encountered in Claims Management—Time Claims for the cross-delayed events.The third part is the analysis of Time Claims for the cross-delayed events. Through making the define conception of the cross-delayed events by the reference in China and abroad, it concludes the problems which should be pay attention in such Time Claims. At last, it makes a summary and prospect.The innovation of this paper is:(1) Taking the FIDIC contract conditions as standard, combined with the legal requirements of contract, technical requirements and the characteristics of Float Time, it gives the responsibility standard of Time Claim for cross-delayed events.(2) Based on TIA, absorbing the core ideas of inverse network construction method, it puts forward the improved "influence time" calculation method of Time Claims.
