Study On The Organizational System And Disposal Methods Of Claims In Construction Enterprises

Along with the reformations of our economic system and contract system in engineering construction, construction claims become more and more important. However, claim appears too late in our country, it is still developing. There are much deficiency in our policy to adopt to the development of claims. People who participate in the ngineering construction can not know the claim ringht an deeply, and they are short of thy theory and experience about claims.This article is base on the analysis of the present situation of claims in our country and abroad, then study on the organizational system of claims in construction enterprises.And do some researches on the disposal methods of claims in the 08 code of valuation with bill quantity of construction works.The main contents and innovations of the paper are as followed:(1) The claim management system mainly means detal operations of construction claim, including how to discover the opportunity, lodge a claim, collect the evidences, dispose, summarize and file. According to the analysis, it is divided into three parts to study and summarized in this article, including claim opportunity recognition, disposal, summation and file. For example, it summarizes the construction claim disposal procedure figure and the advantages and disadvantages of the dispute solving methods.(2) Build and solve the dicision making game model of establishing claim organization, and then get the conclusion is that the dominant strategy between owner and contractor is (establishing claim organization, establishing claim organization)(3) This article summisizes the influencing factors and the principle of establishing claim organizational system, based on which determine it is unnecessary to build special functional divisions for claim in small construction company. Instead, they need to establish claim management organization in concerte projects.They should use straight line function organization in small or middle projects. For large construction enterprises, they should establish function divisions in matrix organization in headquarters, and also use matrix organization in projects. This article also gives the advantages and disadvantages of different organizations.(4) Analyse and summisize requirements of setting personnel and the comprehensive quality of the personnel. Otherwise, it also studies on the claim ensuring system.(5) Analyse and summisize the difference between 08 code of valuation with bill quantity of construction works and the 03 code of valuation with bill quantity of construction works. And then do researches on construction claim methods in new code of valuation with bill quantity of construction works.
