Rural housing and the residential land, are closely related to farmers' interests, from a certain point of view, it is not only information on farmer's life is also the means of production for farmers, with a special status. However, because China's social security system in rural areas is missing, the existing rural land system, through the policy-related restrictions, bundled with basic social security functions, thereby curing housing and the Homestead the means of subsistence property, ignores the means of production properties. This led, on the one hand, in the current legal and theoretical system of rural housing and the residential land management, there are inherent contradictions and short-comings need to improve and perfect; the other hand,there are loopholes in the current management policy, divorced from reality, hindered the development of rural economy and the increase the income of peasants.In this paper, the existing systems and policies of rural housing and the residential land ownership management are systematically organized, to reveal the problems exposed in practice and put forward the idea of improving the management system. The main contents are as follows:1, Survey the development and changes of China's land and real estate management system since the ancient times to the founding of the former, as well as Xiamen modern management situation of land and real estate ownership management system. Elaborate on formation process of China's rural land system and rural residential land use right system after the founding of China, described the evolution of the relevant regulations and policies, as well as the evolution of Xiamen City real estate ownership management system.2, Elaborate on concept, characteristics and the right content of rural housing and the residential land ownership, clarify the social significance of set rural residential land use right system in the primary stage of socialism in China.3, Introduce the exploration and practice overview of rural housing and the residential land ownership management all over the country, describes the case of rural housing and the residential land ownership management in Xiamen. Xiamen City as an example, elaborate management policy of rural home ownership and the residential land use right:(1) the approval management; (2) the registration management; (3) the handling of historical issues; (4) the operational methods of the principal business; (5) the technical requirements of investigation and measurement; (6) the flow management; (7) the mortgage management; (8) the inheritance; (9) the termination.4, Analyze the defects and problems in management system, laws and regulations, and theoretical system of rural housing and the residential land ownership, combined with the actual situation shows some phenomena of lose touch with the society on rural housing and the residential land ownership management system5, Proposed the perfect idea of rural housing and the residential land ownership management system:(1) improve the legal system of rural housing and the residential land ownership management; (2) in accordance with the requirements of optimal allocation of resources, establish and improve rural housing and the residential land ownership management system; (3) establish and improve rural social security system, relieve rural land system of security features.
