Since 1980, the environment has been becoming a worldwide topic. Many countries began to search a way for the development of economy without the pollution of the environment. China has also fixed sustainable development as the direction of economy in the 11th five-year-plan with the emphasis of Environment-friendly society, Clean Development and Sustainable Development as well.Environmental regulation policy is a means to coordinate the contradiction between economic development and environmental protection, simultaneity it is also an important control measures of achieving sustainable development strategic goal. As the Chinese related-theoretical research is lagging behind the economic development situation, so that when the enterprises deal with the environmental regulations, the first reaction of the enterprises is to resist or passive acceptance, or to seek ways to weaken the effect of environmental regulations, rather than cooperating the environmental regulation to meet the requirement of environment, it is quite evidence that deviate the present domestic and international environmental development phase. Based on this phenomena, nowadays around the environment for economic development in China, the study of the theory that the environmental regulation have the impact of prompting the innovation on the enterprises, and to achieve a win-win results between the government and enterprises, it is provide the theoretical basis and practical guide for current national economic planning.In this paper, an analysis of the status of China's environmental regulation, indicating the implementation of environmental regulation policy, the implementation of the article intended to introduce the flaws against the environmental regulation system. Then describe the current implementation of specific environmental regulation measures and analysis of conditions for its implementation.In this paper, the theoretical frameworks to build an environmental regulation of the transmission mechanism to stimulate enterprises' innovation, environmental regulative measures to determine the costs of enterprise's pollution control, thereby affecting the cost-benefit of enterprise innovation, and ultimately determine the prompting of enterprise innovation. In the analysis method, through the game theory analysis to attain a conclusion that under a center intensity inspect the enterprises will reveal the real polluter, then base on this hypothesis by use the mathematical model to analyze the existing environmental regulative measures, whose impact of incentives for enterprise innovation. In the end, to attain a conclusion that the economic incentive measures for environmental regulation are better than the command controlled environmental regulative measures to stimulate innovation by enterprise to make decisions. Obtained in the analysis process with the development of regulative measures, the Government's leading role in environmental regulation weakening and the public participation in the improvement of innovation in enterprises in order to reduce pollution will increase. The more main body participate in the process of environmental regulation, the more notable incentive of innovative in order to reduce pollution by enterprises.This article concludes depend on the discussion earlier, indicating the application of existing environmental regulative policies, and to give advice base on the Chinese fact; about how to improve the extent of public participation in environmental regulation to promote enterprise innovation, the related policy development advices are about to give advice as to change the relationship between government and enterprises, to push the new form of control, to divide the regulation to more parts and to encourage public participation in the regulation and so on.
