Principle And Practice Exploration Of Agricultural Product Geographical Indications

Agricultural product geographical indications were originated from the geographical indications. The geographical indications were used to identify some product from certain region or certain area or place in this region. It provides the specific information of its production area, more importantly it's a kind of quality assurance. Although the geographical indications are not confined in agricultural products, agricultural products often possess some characteristics of its production are and are affected by special geographical factors such as climate and soil and so on. Therefore, geographical indications are important for agriculture product production. In the beginning of this century, China began strengthening the protection and trademark registration of the agriculture product geographical indications in the construction of new socialist countryside, then the agricultural product geographical indications became the research object of serving the development of rural economy, and caused great interests of the agricultural product units. But after the issue of geographical indications was included into the TRIPS, protection for the agricultural product geographical indications had been a new hot point in the theoretical circles and the rural economy practices.China is a traditional large agricultural country with long history. For promoting and upgrading agricultural industrialization, enhancing the quality standardization of agricultural products and making the brand strategy of agricultural products in China, it's of realistic and profound significance to vigorously promote the protection system of the intellectual property right of the agricultural product geographical indications, and take law protection for the origin agricultural products.However, as the history of protecting agricultural product geographical indications in China is short, and related study was carried out late, currently, the study of protection for the agricultural product geographical indications was often from the traditional law aspect. It's of practical significance to discuss and analyze the issue of protecting agricultural product geographical indications from the angle of the development of rural economy. From the new angle of promoting rural economy, and on the basis of summarizing and drawing the relevant research results home and abroad, this paper carries out the issue from the comparison between the definition and the connotation, trying to clarify the exact meaning of the agricultural product geographical indications. Via reviewing the development process of protecting Chinese agricultural product geographical indications and analyzing the existing protection mode, this paper concludes there're three major problems in the existing protection mode of Chinese agricultural product geographical indications, such as the obstacles in the system, awareness and operation. Then by using such economic theories as the demand elasticity and cost value, this paper makes theoretical and practical analysis on the economic benefits of the agricultural product geographical indications. Meanwhile, this paper takes Fujian as the research sample, through the two specific examples of An Xi variety of OOLONG TEA and ZHE RONG RADIX PSEUDOSTELL, to study the practical application of the agricultural product geographical indications, and makes an empirical analysis of the influence on the economic benefits of agricultural products by protecting agricultural product geographical indications, so as to demonstrate the importance, necessity and feasibility to improve the protection mode of the Chinese agricultural product geographical indications. At last, this paper makes preliminary elaboration on how to make good use of the important intellectual property rights and improve the competitiveness of the Chinese agricultural products in international market. Meanwhile, this paper manages to solve the conflict in protection from the design of the system, solve the subject vacancy from strengthening supervision management, and solve the unsmooth in daily operation from strengthening the function of the industrial organization, thus puts forward suitable protection system of Chinese agricultural product geographical indications and corresponding policy suggestions.
