The fast development of Chinese economy consumes a great deal of mineral resource.However, under the influence of the view that mineral resource is valueless,the mineral resource is wasted very much in exploiture.The need for mineral resource in economic construction makes it urgent constituting the legal system of acquiring mineral resource for value in China.In developed countries mineral resource is capital in market,so acquiring mineral resource must for value.We can learn their experience when capitalizing mineral resource and constituting the legal system of acquiring mineral resource for value in China.The thesis points, constituting the legal system of acquiring mineral resource for value must conform to four theories.They are national ownership of mineral resource,mineral resource's value,producing outside theory and Maxism land rent theory.These four theories decide the importance of the legal system and have an influence on the price of mineral resource.We constitute the legal system of acquiring mineral resource for value in economic reformation.After generalizing the legal system existing,the thesis memtions there are three principles for consitituting the legal system of acquiring mineral resource for value: national ownership,scientific system and harmonious system.The thesis points the legal system of acquiring mineral resource for value has five parts:right cost,compensatal fee,regulatal fee,depletion allowance and environmental deposit.These five parts have different function and every one is necessary.The thesis points the system existing should be reformed and brings forward the way for reformation. Making mining manufacturers paying tax fairly,the thesis points,the tax for mining manufacturers should be reformed when consitituting the legal system of acquiring mineral resource for value.At last the thesis points we should study on consitituting the law of acquiring mineral resource for value which be enforced in China.
