| Along with the fast economic development of China, people have begun to desire a better life than ever before, which urges our old social security system to be reformed in order to improve the security level. Among all the innovation of the social security system, the reformation of legal supervision over the social security fund is the most important. I intend to do some research on the legal supervision over social security fund in this paper and try to bring forward some advice about how to design the legal supervision system of social security fund. The paper consists of 4 chapters together and each chapter sets forth the following content.Chapter one draws an outline of social security fund in order to restrict the extension of social security fund, which is the object of legal supervision in this paper. This part starts with the financing mode of security capital and indicates that only those need to be accumulated and to be operated constitutes social security fund, which includes the essential retirement pension fund, national social security fund and enterprise pension fund. The part also analyses the contents of these three legal relationships separately.Chapter two works over the actuality in China of legal supervision over social security fund basing on the research in the first chapter. The investigation into the actuality proceeds with both regulations and practice: For the regulations I enumerate the active rules in China according to the force ranking. As for the practice I point out the problems in financing, safekeeping, investment and supervision of the fund operation according to their flow sequence.The third chapter introduces foreign experiences of legal supervision over social security fund and also the trend of its development. I give the examples of the USA, Singapore, Ireland and Chile to show their practice in legal supervision over social security fund. Combined with experiences and lessons in other countries, I summarize the international trend of the development in order to be used for reference in social security fund system construction in China.The main content in the fourth chapter is the nine issues under definition in legal supervision over social security fund in China. The issues are brought forward grounding on the sensible cognition of the situation of the country on one hand, and on the other hand benefit from the analysis and comparison between actuality in China and foreign experiences. On the turning point of"Social Insurance Law", I stress on the system construction of essential retirement pension. At the same time advance some supervision proposal for national social security fund and enterprise pension fund. |
