The Study On The Problem And Countermeasures Of Market Economy Status To Answer The Anti-Dumping

China has adopted the reform and opening policy for more than twenty years. Chinese market economy has come into being. But in order to enter the WTO earlier, article 15 in the Protocol of China's accession to the WTO says: foreign countries may regard China as a non-market economy country in the cases of anti-dumping during the coming fifteen years. Therefore, western countries such as the EU and the USA refused to approve Chinese market economy status because of political and economical factors in anti-dumping investigations against China. They mainly apply"Subrogate Country"to calculate the normal value of Chinese goods in adjudicating anti-dumping cases, which brought forth much difficult to Chinese enterprises'reply to accusations. It also caused serious damages to the economic benefits and the development of economic of China. It is known to us all that China is facing most anti-dumping accusation in the world at present. Especially after the first anti-dumping from the EU in 1979, over forty countries and areas accused our country of anti-dumping. Hundreds of kinds of products are involved in anti-dumping. For this reason it is of positive and practical significance to study the importance of market economy status in the cases of anti-dumping and the countermeasures of our country.The dissertation consists of four chapters. Chapter one is about dumping and market economy status. It summarizes the connotation of dumping from difference organizations and countries in different periods. It analyzes the dumping from the sides of economics and law. It introduces the source of market economy status and different standards from the countries of WTO and various actions in the practice of the EU and the USA. Chapter two states the effects from market economy status by analyzing subrogate country system through an anti-dumping case on color TV of U.S. towards China. Chapter three makes a research into the reason for lots of anti-dumping charges from home and abroad. Because of the key role of market economy status in dealing with the anti-dumping issues, the writer makes a detailed statement on this problem in this article. Chapter four proposes the corresponding countermeasures under the anti-dumping investigations in the respect of the accounting study on anti-dumping, strengthening the government's negotiations with the foreign countries, realize the effects of the associations and the developing the enterprises'motives and potentials to reply to accusations.
