The Study On The NPC's Financial Supervision

According to the Constitution of People's Republic of China, the National People's Congress has the power of supervision, including the authority to supervise the governmental finance. However, NPC has not effectively performed its power of financial supervision for the following reasons.At first, the laws for the NPC's financial supervision has not been completed and systemized. There is no clear and workable performing procedure in law for the NPC's financial supervision.Secondly, the NPC and governments of all levels have not recognized the importance of the NPC's financial supervision. In addition, there are many systematical problems interfering with the NPC's power of financial supervision, such as the blending of Communist Party of China and government, the lack of financial staff of the NPC, and etc.In order to guarantee the NPC's performing its power of financial supervision, it is a key to complete the law system and draw up the performing proceedings in detail for the NPC to make full use of its part of financial supervision.The thesis puts forwards the idea how to complete and strengthen the NPC's power of financial supervision on the basis of the thought of the Sixteenth National Congress of CPC which is "strengthen the restraint and supervision to the power". Related laws must be refined and completed, and a law of financial supervision should be worked out if necessary. The NPC should also strengthen its own construction to acquire the ability to perform its power of financial supervision.It is believed that the constructing idea put forward by the thesis will promote the NPC's performing its power of financial supervision.
