A Study On Circulation Of Collective Construction Land In Rural Areas

According to the current laws and regulations, the collective construction land in rural areas of our country is forbidden to circulate in market in principle. However, under the attraction of comparative interests, the underground circulation market of construction land has formed spontaneously and privately which make it the objective existence of entering the market. But as now our country's strategies and laws about collective construction land lag the growth of the land market, it is urgent to regulate the circulation of the collective construction land. In this way, the research of the circulation criterion for the collective construction land shows an important significance.This article can be mainly divided into five parts. The first part summarizes the general situation of the collective construction land circulation. It makes a definition of the collective land and the circulation of the collective land , then summarizes the reasons and meanings of the circulation of collective construction land. The second part analyses the actuality and summarizes the forms and figures. The third part makes a concrete analysis on the problems and reasons in the practical circulation courses of the collective construction land. It focuses on the laws and regulations, property right system, benefit distribution, rights guarantee and the circulation management during its operation. The fourth part analyses the experimental patterns of the circulation of collective construction land, it makes a comparative analysis on the circulation patterns in certain representative areas such as Wuhu in Anhui Province and Suzhou in Jiangsu Province. The fifth part gives some suggestions basing on the experimental experience from the main places. The countermeasures for the future institutional design of the circulation of the collective construction land are as follows: modification of the law, construction of the property system, perfection of the rights and interests system, improvement of outer environment and reformation of related system and so on.
