Research On Anti-dumping Against China Exports

With the strengthening trend of the global economic integration, and the increment of China exports, the influence of global trade protectionism also strengthens further when getting into 80's in 20 centuries. Lower along with the tariff after joining WTO especially, various non- tariff barriers piles up one after another. In these non-tariff barriers, dumping and anti-dumping are the most familiar and also useful, and become one of the focus in the international trade problems nowadays. China suffered very serious economy loses every year because of anti-dumping. In view of case number, China has already become the main target of the international anti-dumping and the biggest victimizing country. From 1995 to 2006 (June), the case number of anti-dumping for China exports has reached 500, which is first in the world. Among those, anti-dumping for basic metals and its products is 112 times, and is the most serious in all cases. The base metals industry is considered as "setting sun industry" in developed countries and protected positively by domestic government. Anti-dumping, being affirmed by GATT and WTO, are used frequently to protect national benefit by western countries. Faced with the frequently anti-dumping accusation for the basic products of our country export, how should Chinese enterprises deal with anti-dumping according to the current international rules? It becomes the research topic for some enterprises.The anti-dumping for basic metals and its products have its specialty, also share some common characteristics with that for general merchandise. About the common characteristics, the anti-dumping for the basic metals exported to America and Argentina were contrasted and analyzed with some evidences in this paper. About the speciality, anti-dumping for basic metals and its products were researched by analyzing the phenomena, reasons and the settlement. Because of the anti-dumping for the base metals and its products, the multinational company that partition a market, one country or two countries that is durative, and concatenate anti-dumping emerged. Aim at the emergence, detailed analysis was done. Study showed that current anti-dumping for merchandises of China exports were not caused mainly by some familiar aspects, such as political, variety, and price variety, but other reasons. Recognizing the base metal products to export anti-dumping real reason, will contribute to increasing us to export a merchandise to China anti-dumping reason of comprehension. Recognizing the real reason leading to the anti-dumping for basic metal and its products, will contribute to comprehending further the cause of anti-dumping for merchandises of China exports.The main contribution of the study lies on: one, anti-dumping law was described detailed and the settlement was suggested form the angle of law. Two, about the common characteristics, the anti-dumping for the basic metal and its products of China exports to America and Argentina was studied as the typical model with substantial evidences. And the anti-dumping problem was very clearly analyzed. Three, about the specialty, the reasons caused the multinational company that partition a market, one country or two countries that is durative, and concatenate anti-dumping, were analyzed in the study. It showed that, sometimes, the anti-dumping was not obviously related with the political aspect, the amount of merchandises, and price etc. Four, from the angle of the special reasons, an anti-dumping settlement was put forward pointedly.
