Research On The Influence Of The Protection Of The Intellectual Property Rights On China's Foreign Trade

In the times of knowledge economy, Intellectual Property Rights (IPR) played animportant role in the development of world economy and international trade. TheProtection of the IPR also became the hot discussion along many countries. At thesame time, some shortages in the protection of the IPR of our country were caught byfew advanced countries as hinders of the foreign trade, and led to some loss of us.Therefore, we must strength the protection of the IPR to foster the development of ourcountry's foreign trade well and rapidly. This paper aims at analyzing the influence ofthe Protection of the IPR on China's foreign trade in details, and offering some basicstrategies on them. This paper includes both the theoretic and realistic meanings.(1) Combining the Theory of Property Right Economics with the Theory ofInternational Trade Economics to construct the newly analysis frame of the Protectionof the IPR. This frame centers in the theory of Externalities and the theory ofTransaction Cost, and fuses the theory of the Cycles of the Product, ComparativeAdvantages and Competitive Advantages theories together, to verify the possibility ofstrengthening the Protection of the IPR. This mode makes a breakthrough because itbrings the two different economic theories together, it would be a innovation. And italso supplies a powerful support for our description of the relationship between theProtection of the IPR and China's foreign trade.(2) Constructing two models from macroscopic aspect and the middle aspect toexplain the influence of the Protection of the IPR on China's foreign trade. One of themodel demonstrates the influence of the amount of the patent application on China'simport & export trade, and another model demonstrates the amount of the patentapplication on China's high and new-technology products exporting. Owing to itsgood representiveness and typicality, I choose the high and new-technology industriesto make model. This method argues the problem from its realistic necessity and avoidthe blindness, which formed the unique characteristic of this paper. (3) By analyzing the problems of China's Protection of the IPR step by step, thispaper demonstrates the influence of the Protection of the IPR from the professionalangle of trade. The IPR discord is becoming hotter in the international business, sosome important influence can be reasoned by discussing this problem. The maininfluences are on import & export trade, processing trade, attracting FDI, absorbingtechnology proliferation and so on. The conclusion can be known that our countryhave to strengthen the Protection of the IPR. This reasoning process is very strict andcomplete, as it cut all the material irrelevant to the subject. This part forms the core ofthe paper.(4) Proposing some basic advices to protect our IPR, covering all the socialsystem, strategy, law, enterprises aspects. The main contents of the advices areoptimizing the IPR systems, carrying out the strategy of IPR; strengthening theconsciousness of IPR protection; elevating innovation ability of the enterprises. Suchanalysis system covers the main body including country, enterprises and citizens, andanalyzes from the upper domain to lower domain, having strong feasibility.(5) Adopting obvious data, graph, formula to explain the problems, together withthe description to enhance the persuasive power. According to the different necessityto make different graphs shaped folds line, pillar, cycle, as to demonstrate the totalamount, proportion, development tendency and so on. This paper emphasize themathematic analysis and use many real data as proof, all of which made greatcontribution to the explanation of this paper.
