Land acquirement is the transfer of ownership between the nation and the collective. Land acquirement for national construction is an important measure to meet the public benefits and to sure the need of land for public construction. Land acquirement for national construction is an administrative act with compulsory. The order of land acquirement is administrative order, so the collective land acquired has to conform. But the land acquirement is compensatory. The collective group could get economic compensation according to the law. As the development of economy and the transformation of economic system, the land system has undergone three big changes. But the system of land acquirement never changes accordingly. The contradiction between the system of land acquirement, the land system and the need of market economy development is becoming bigger. The problem of benefits dropping is bigger for the contradiction between administrative act and market economy. As to compensation, there is no common saying and there is no detail measure. As the fact, it won't deal with all the problem of benefits dropping in land acquirement just to raise the measure of compensation.The paper adopts quality and quantity way to analysis the problem of benefits dropping, from the contradiction between administrative act and market economy, in land acquirement and compensation, basing on the contrasting analysis of the nation and abroad, and promotes to reinforce the protection of benefits through improving the aspects of ownership, compensation measure, social protection and government function.
