In 1984, people's basic housing needs was mentioned in"Universal Declaration of Human Rights"passed by the UN General Assembly. And then it was re-mentioned in International Covenant on Economic, Social and Cultural Rights in 1966. In April 1981, the International Symposium on Urban Housing Problems was hold in London and Residential Declaration of Human Rights was passed then. The Declaration indicates that living in a good and healthy living environment is the basic human rights for all residents. Our government has also did many beneficial explorations in solving the basic housing problem for residents, such as providing the public rental housing, which is mainly aimed to solving the housing problems for the low income. As a result, the housing security program is formed by the "seamless"joint by both the low-cost housing and affordable housing.The author has done a lot of research on the Situation of implementation of the public rental housing and consulted a large number of interrelated documents. Based on those efforts to study the legal regulation of the public rental housing.This paper is divided into four main parts besides the preface and epilogue.The first part of this thesis indicates the concept and the origin of the public rental housing. The second part studies the development courses and the referential experience of the public rental housing in compaison of Japan, Korea, and the US. The third part mainly refers China's national conditions to discourse the implementing status of public rental housing and some problems emerged in the process.The fourth part the author puts forward her own construction of legislation according to the existing main problems, which includes the basic principles and some specific legislative proposals.
