The Research On Development Of Agricultural Cooperative Economic Organizations And Effect Of Appropriate Scale Of Operation

Based on China's basic national conditions, At present Chinese agriculture must insists the system of contracted responsibilities on the household basis with remuneration linked to output stably . On this basis, there does exist so-called three agriculture problems, in another word, "agriculture, countryside and farmers" at the present stage. More precisely, the present agriculture problems can be demonstrated as flowing: Fertility but no harvest; conflict between small agricultural production and big market trade; the low land productivity; the constantly decreasing labor rate; the abandonment of uncultivated land and so on. In order to perfectly solve the mentioned problems above, we must get the farmers organized to carry forward our Modernizing Agriculture with goingtoscale,standardization and industrialization, in which to build impeccable agricultural economic cooperation organization has been promoted to be the best choice. However, due to the fuzziness of the legal nature related to the agricultural economic cooperation organization in related legislations, many non-standard deeds appeared during the process of implementation and execution. The fact also leads many problems and disadvantages in the development process of the organization for economic cooperation which causes losses to farmers and then badly hinders the development of agriculture in our country.Therefore this paper indicates a detailed discussion on the legal nature of Agricultural economic cooperation organization, and gives the opinion that the current cooperatives law should be perfected by making detailed description about escheatage, and also suggests that a relevant laws should be speeded up to make up the drawback of legal person in the civil law about the four classification of legal person. A combination of successful stories about cooperatives in Taian will be discussed to show the specific function a cooperative should express and how to do. At last, this paper puts forward a comparative analysis of the development of modern agriculture cooperation in China and then proposes that this mode of organization should be the most proper one at present stage and must be promoted in the largest scale.
