Research On Corporate Social Responsibility In Economic Law

Since the twentieth century, the social problems caused by the rapid development of enterprises have become increasingly serious. The blind pursuit of profit at the expense of the well-being of the whole society has aroused a growing number of protests and discontent, which has finally led to the emergence and development of corporate social responsibility. Nowadays, the enterprises are required to break through the traditional 'Monism' which aims only at the pursuit of maximum economic benefits and try the best to maintain and enhance the interests of the stakeholders such as employees, customers, creditors, communities and environment while purchasing the maximum economic benefits.After the implementation of the policy of reform and opening up, the concept of corporate social responsibility has aroused common concern within Chinese law world and has been continuously added into the China legislation. However, the frequent incidents of food and production safety in China in recent years have made the research of this issue more urgent and realistic. Therefore, this thesis intends to explore the corporate social responsibility from the viewpoint of economic law through the methods of theoretical and empirical analysis, comprehensive literature reading, analysis and appraisal.The thesis can be divided into five parts:Partâ… :Introduction. This part endeavors to set out the background and research significance and clear the current state of the research worldwide by literature review in order to provide literature basis for the definition of the corporate social responsibility later in the thesis.Partâ…¡:Definition of the history and essence of corporate social responsibility. This section aims at examining the source and development of corporate social responsibility and analyzing the features of the theory of corporate social responsibility. Perspectives concerning the meaning, nature and content of corporate social responsibility are made clear in order to remove the barriers in discussing the concept of the legitimacy of corporate social responsibility.Partâ…¢:Theoretical Analysis of corporate social responsibility and its practical significance. By finding and exploring the theoretical basis for corporate social responsibility to emphasize its practical significance in China. The question of why should enterprises fulfill their social responsibility, in another word, the problem of the legitimacy of corporate social responsibility, is answered here.Partâ…£:Correspondence between economic law and social responsibility. This section analyzes the correspondences between economic law and corporate social responsibility in terms of enforcement objective, value orientation, special adjustment method, and the coordinating role of balance. Through analysis, the theoretical basis concerning economic law for corporate social responsibility has been found.Partâ…¤:Construction and perfection of Corporate Social Responsibility System in China. After first starting with the current corporate social responsibility situation in China and then analyzing the problems and reasons of the social responsibility undertaken by the enterprises, preliminary choice has been made on establishing and improving the corporate social responsibility system.
