Since entering21stcentury, ocean has become the focus of the world attention. Thereport of18thnational congress of CCP indicated that “we should improve marineresource development ability; develop marine economy; protect marine ecologicalenvironment; safeguard marine rights and interests; and finally build a powerful marinenation.” with the proposal of the powerful-marine-nation strategy, the inevitableeconomy development direction is to ask resources, growth, room, environment andfortune from the ocean. However, with the continuos development of the marineeconomy, marine environment pollution becomes more and more serious. According toChina’s marine environment bulletin in2012, China’s offshore environment wasseriously polluted in2012, the pollution came from land runoff and outlets was morethan1.9million tons, which accounts for eighty percent of the marine pollution.Land-sourced pollution has become the marine source of the marine environmentpollution. Our government started to pay attention to land-sourced pollution in the1990s, until now we have build a more than seventeen law policy system, includingMarine Environmental Protection Law of the People’s Republic of China andRegulations of The People’s Republic of China on The Prevention of Pollution Damageto The Marine Environment by Land-sourced Pollutants. They have detailed stipulatedland-sourced pollution management, while the effect is not obvious, the discharge loadof the land-sourced pollutant increased continuously. As the author think, besides theimperfection of the management policy, the problems during policy implementation isthe marine reason that result in the bad manage effect.This paper uses literature analysis and induction demonstrate to research. It teasesthe research result both in China and abroad, and finds that most research in Chinafocus on legal system and technological means, which is not so thorough inmanagement policy implementation. Therefore, this paper starts from China’s land-sourced pollution management policy. By teasing the policy system, it finds outthe imperfection of the policy contents, and then analysis the current situation anddilemma during policy implementation which take Regulations of The People’sRepublic of China on The Prevention of Pollution Damage to The Marine Environmentby Land-sourced Pollutants as the example. Then, it proposes some suggestion toeffectively implement the policy, which expected to improve the policy implementationsituation and reach a better management result. This paper is divided into five chapters:The first chapter firstly elaborates the core concept that included in the paper. Itintroduces marine environment pollution, land-sourced pollution and land-sourcedmanagement policy separately. This chapter mainly the concept and variety ofland-sourced pollution. Besides, it defines land-sourced pollution which is the researchobject of the paper. Then, this chapter tells the reason that it chooses managementpolicy implementation as the research focus.The second chapter is mainly focus on the current land-sourced managementpolicy in our country. It teases the management policy with the principle of state laws,administrative regulations, ministries regulations and technical regulations. It clarifiesthe development and situation of policy, meanwhile it defines the imperfection of thecurrent policy.The third chapter takes Regulations of The People’s Republic of China on ThePrevention of Pollution Damage to The Marine Environment by Land-sourcedPollutants as the example to analysis the current situation and implementation effect ofthe policy. In that context, it further analysis the dilemma during the policyimplementation. On this basis, the current implementation situation of Regulations ofThe People’s Republic of China on The Prevention of Pollution Damage to The MarineEnvironment by Land-sourced Pollutants is mainly as follow: some content are notactually implemented; ministry of environmental protection does not promote iteffectively; grass-level environmental protection administration don’t carry outeffectively; the implementation of the regulations is mainly rely on administrative order;polluters don’t carry out the regulations; the public pay little attention on the implementation of the regulations. This paper think that the incomplete policy systemand implementation mechanism, the single executive body and method as well as theweak policy implementation supervision are the main reasons that result in the dilemmasituation.The forth chapter mainly introduces the successful experience during Japan andAustralia’s policy implementation. By summing up, we can find some common featuresthat they all have diverse implementation bodies, various implementation means andhigh-efficient supervision. All this successful experience can give us good references.The fifth chapter is mainly focus on the countermeasures of our country’s policyimplementation which is based on the problems and reasons of the land-sourcedpollution management policy implementation. It proposes certain measures from policycontent, policy implementation body, policy implementation mechanism, policyimplementation means and policy implementation supervision.
