Study On The Legal Governance Of Environmental Problems In Xi’an Urban-rural-integration-area

Environmental problems are serious issues of our society under the backgroundsofindustrialization. Therefore, it is important to find some solutions, which based oninstitutional approaches and from the perspective of laws. In is paper, the legalgovernance of environmental problems is the specificresearch object, and Xi’anUrban-Rural-Integration-Area is the concrete analysis units. The research methods ofthis paper mainly are empirical analysis and normative analysis. Xi’anUrban-Rural-Integration-Areais a special areain wherea variety of problems andcontradictions areassembling and accumulation. Generally speaking, it is in a state ofanomie. So, reconstruction its order is particularly urgent. Environment order, to someextent, is an important part of the whole order. Thus, it is significant toreconstruct theenvironment order, under the framework of the law, namely the legal governance ofenvironmental problems.This articledefined the technical terms of Urban-Rural-Integration-Area, which basedon summary the previous research on the concepts ofvillages in city and rural-urbancontinuum. This article also developed an identificationindex system, through which wecan confirm our analysis units. There are two types ofenvironment problemsin Xi’anUrban-Rural-Integration-Area; they are environmental pollution and ecologicaldestruction. The causes of these problems are complicated. The adjustment of industrialpolicy, the overheated exploitationdriven by lonely economic considerations and thesocial structure beyond its bearing are three main causes. In order to describeaccurately,this papersummed up the status of governance into two modes. One called comprehensive governance mode and the other called special projects mode.Throughout the process of the governance, there were four problems as follows:theregulationsystem did not exhaustiveness, the fundamentalmechanism was failure, thedistribution of the duties was too scattered, and the campaign-styleenvironmental lawexecution.The essence of the governance of environmental problems is to reconstruction theenvironment order. Looking from a broadlyperspective, it faces the followingchallenges. First of all, it is the problem of antinomy about developing economy andprotecting environment. Secondly, it is the problem ofthe effectiveness of the law, whoplayed a shaper role in reconstruction the environment order. Thirdly, it is the problemof the particularity of the social structure in this critical transition period. In the processof the governance, introduction and application the economic analysis toolsare veryimportant.From the point of the legislation, clarify some ideas is essential. From thepoint of theexecutive, a clearly defined role of the executive branches is required.Clarified all above problems, this paperput forward some countermeasures from theperspective ofstrengthen thecivil society building, improve the legislation andstandardize the law enforcement.
