The reason we think thatis, resources globalization is both an opportunity of economic development andchallenge of mineral resource safety assurance for our country. The concept ofmineral resources safety is a safe state, under that a country can effectively cope withthe threat of various destructive factors in the development and utilization of mineralresources, to ensure the sustainable development of society, economy, environment,resource status. So it has important strategic significance for a country’s nationalsafety assurance. Since the beginning of the formation of mineral resources safetyview, it has caused widespread concern and regarded as the content of the sustainabledevelopment. Many countries around the world have actively taken measures tolegislate for mineral resources safety. With the development of the connotation anddenotation of mineral resources safety view, it presents the open, dynamic,comprehensive trend.Strategic mineral resources are dominant in a country’s resources supply anddemand system, which has the risk of supplies in a state of emergency and amonopoly under the normal state. Influenced by various factors at home and abroad,strategic mineral resources safety assurance situation is grim in our country. Ourlegislation in this area has many shortcomings. Therefore we must improve relevantlaws and regulations to ensure strategic mineral resources safety assurance.In this paper, by analyzing the present state of relevant legislation in foreigncountries, summarizing the experience of worth our using for reference, we believethat to perfect strategic mineral resources security legislation in our country, we mustdetermine the guiding ideology and basic principle of legislation and under theguidance of that, adopt a hybrid legislation mode. According to this model, we need toabolish old laws, make new laws and modify inappropriate laws. To be specific, itneeds to modify the existing “Mineral Resources Lawâ€, draw up a “Strategic MineralResources Protection Ordinance†which has a higher effect and make other relevantsupporting law files. |
