Climate resources exists in the climate environment whichcan affords human the substances and energy. It is includedlight energy, heat, precipitation, wind energy and the otheratmospheric composition energy. It is a basic natural resources,strategic economic resources and public social resources. Ithas far-reaching meaning to the sustainable development inChina. Perfecting of climate resources protection legislationis very important to protect the ecology value of climateresources, balance the climate and ecology system and exert thesocial value of climate resources to keep the sustainable usingof climate resources economic value. The purpose of this paperis to perfect the climate resources protection legal system,promote the legislation.This paper first discusses the basic theory of climateresources protection legislation in China. Climate resourcesis a typical natural resource which is natural, social andvaluable, it is different from other natural resources. Climateresources have the characteristic of "objects" which canbecome the object of legal relations. Therefore, we shouldenact a special law to regulate the development, utilizationand protection of climate resources protection laws relates to environmental protection and in the areas of legal norms.Climate resources protection legislation is practicalnecessity and feasibility.The second chapter deals with the current situation ofclimatic resources protection and legislative issues in China.There are some problems in the actual climate resourceslegislation: it is lack of legal resources climate protectionsystem, climate resources has not yet been established legalconcept, actual legislation can not fully adjust therelationship of climate resources utilization and protection.It hash't created climate resources protection managementsystem, the legal system and legal responsibilities are notperfect, etc.The third chapter studies on the basic suggestions ofperfecting the climate resources protection legislation. First,it deeply discuss on how to improve the climate resources legalsystem. The core of climate resources protection law systemis to set up "Climate Resources Law". It deeply studied onthe legislation responsibility and purpose, the basicprinciples, systems, management systems and the legalresponsibilities. The idea of setting up the law "to safeguardclimate resources ecology fair and national ecologicalsecurity", the legislative responsibility and purpose is toprotect the climate resources, prevent the climate disasters, keep the climate system stability, keep the ecological systemon balance and achieve the harmonious development of economy,society and climate environment sustainable use of resources.All other legal systems are designed on this basic idea andlaunched under the guidance of the same attention as avalue-oriented, structured, coordinated and organic linksunified whole.This paper absorbed the law, environment and naturalresources law, ecological economics resources, climate science,natural science, ecological science disciplines as much aspossible, such as the latest research harvest. It based on thecountry's economic and social sustainable development in thebackground, from the perspective of environmental protectionand natural resources law to study on improving climateresources protection legislation in China. The paper mainlyuses empirical analysis, valued analysis, historical analysis,comparative analysis and economic analysis methods.
