The System Research Of Farmland Property Right During The Transformation In China

With the advancement of reform in market economical system and the development of national economy, it is becoming more and more obvious that the rural economy lags behind relatively. And the government concerns a lot with the development of rural economy. The ownership of farmland, which is an important factor of rural economy development and agricultural production efficiency, are drawing more and more attention.From the point view of property right, this essay adopts comparative analysis and combination of macroanalytical and microscopic analytical method. Based on the practical situation and with the reference of ownership system of farmland abroad, it analyzed the evolution of ownership of farmland in China, it found the main problems in the development of rural economy. The main shortcomings are showed on the following: the main body is not clear, the farmland is fragmented, the property right lacks of succession and imperfect. So it is an urgent task to reform the present ownership of farmland.The target of reform in ownership of farmland is to realize the main body clarity of prosperity right, to make clear the right and duty of each body, to realize the merchandizing of management power for farmland in order to help the rural economy develops steadily and healthily. A new system of property right has been set up. Aim at this reform target puts forward building up the new farmland to produce the power system, then enhance the nation intervention and weaken the collective ownership, practicing the farmer farmland to always management power. Two steps needed: first, basis of the present farmland contracted with 2.4 hundred million farmers, to established farmland management power owned by farmers for ever.
