A Brief Study On The Conflict And Balance Of Free Press And Judicial Fairness

Freedom and responsibility, a unity of oppositeness and a contradictory entity in philosophy, always condition and guarantee each other. The freedom of the press and its legal constraint embody the two concepts in the field of mass media. The conflict between the free press and the legal constraint is, in effect, the reflection of the conflicting value between the pursuit and the constraint of freedom.With the development of science and technology, especially with the rapid development of internet in the 21st century, quite great progress has been made in mass media in China, which, to some extent, has had an influence on people's speech and judgment. What's more, there is nothing new in the phenomenon that people sometimes sue the press at law because of their wrong reports and the news tort has become a hot issue among the press, the legal circle and the public. Thus the debate on the protection and the constraint of the free press has arisen again.The free press in the information age has become a force to be reckoned to promote the social harmony and judicial reform, and to guarantee the sound development of the legal system. Thus there is a great need for us to make researches on the relationship between the freedom of the press and judicial fairness so that we can have a better understanding of them, which is also what I want to deal with in this paper.
