The Reconstruction Of The Relationships Between Mass Media And The Administration Of Justice In China

In China, the mass media and the judicial field are not opposite to each other, but are integrated in social justice. With the aim of realizing the justice of administration and social justice, increasing the benefits of the people, protecting the rights of the people, maintain the development of the democracy and law. Both the mass media and the administration of justice, under the leadership of the Communist Party of China, are two important branches which facilitate a prosperous, democratic as well as civilized society. At present, because of the conflicts between the mass media and the administration of the justice, and the different roles between them, the relationship between the mass media and the administration of justice are quite complicated. For example, the common understanding on some basic issues is not reached. The conflicts are various and general. The rules and the systems are not in details. All of the above reveal the backwardness in judicial system as well as the journalism system, which is a unique phenomenon in developing China.The underlying conflict between them is the conflict between the right to know, the right to say and the independent adjudication, administration of justice, which is quite natural. In the course of the development of democracy in China, a balanced relationship between them will be finally found after long term adjustment. The conflict between the two will be minimized while the civil rights will be maximized.But, how to reform and change the relationship between the mass media and the administration of justice? How to control the conflict and enforce the sound development of the two? The author made several suggestions. On the one hand, the mass media should know their roles. They should not only issue the laws, the rules and regulations concerning supervision of the mass media, but also the focus point of the supervision in order to raise the level of the mass media as a whole. On the other hand, the reforms are greatly needed in the administration of justice. The administration of justice should also react appropriately to the supervision from the mass media.
