Along with the further deepening of economic globalization, the global energy situation is increasingly grim,and climate environment problem is increasingly prominent, as the international energy consumption and pollution emissions of the two major international main Chinese and EU, both from the two sides clean energy complementary development reality, also be considered from a strategic point of balance of power, have a strong incentive to to promote bilateral cooperation on clean energy. At present, as a clean energy cooperation between China and the EU economic and trade exchanges the new point of growth has been achieved fruitful results, transfer coordination, the two sides between the government of the relevant technology and joint development and professional and technical personnel training in everything in good order and well arranged between the conduct of the. But in some points of interest there are competition, both sides of the trade association also inevitably produce friction and some problems, such as the EU’s PV industry "double reverse survey etc.". The normal economic and trade exchanges on both sides is certainly not a heavy blow.At present, most scholars only from politics, diplomacy, economics and other fields to study the EU China clean energy cooperation, both at home and abroad is still lack of systemic analysis and research from the legal theory on EU China cooperation on clean energy problem. This article attempts through international treaties related to clean energy cooperation contrast Chinese and EU domestic legislation and signed, a careful analysis on the legal problems arising cooperation between China and the EU and China EU cooperation in nuclear power photovoltaic industry, combining with the actual situations of China and the EU, and put forward the corresponding suggestions to perfect the legal system of bilateral cooperation on clean energy.
