A Study On The Legal Regulation Of The Election Of The Community In The Community

The community of residents’ committees changed from villagers committee appeares all over the city in China recently and there is lots of difference between this kind of community and the community of traditional residents’ committees.It maybe needs a long time to transit to the traditional one.Whether the Organic law for the residents’ committees, or the implementation of the method or operation procedures, lack work way to guide this kind of special community residents’ committees elections.It. leads to a lot of legal problems in the process of. The paper takes 17 the community of residents’ committees changed from villagers committee in the same Z Street of xi’an as sample and analyses community elections of residents’ committees in the empirical research methods, especially analyzed the legal problems existing in the election process, and puts forward the legal Suggestions on how to regulate.This paper is mainly divided into three parts. The first part introduces the legal foundation of the community elections of residents’ committees the general election and the present situation of the implementation. The second part takes 17 community elections of residents’ committees in Z Street as an example and analyses the legal problems that exist in the election practice:the first one is the election method to determine the more casual; The second one is the controversial qualification of voters; the third one is the unpractical regulation to elect the voter; the fourth one is to delay elections or destroy the election have often occurred; the fifth one is the common phenomenon of bribery in the election. The third part put forward some legal suggestions about the community election of residents’ committees changed from villagers committee:the first one analyzes the necessity and urgency of the e election legislation about the community election of residents’ committees changed from villagers committee. This paper puts forward three principle to the election that is the combination of compulsory and selective, rigid and elastic, education guide with severe punishment of combining these three principles, and start legislaion. The second one is improving the law system of election fraud behavior from the scope of voter registration, resident representative method, curb damage elections and etc. The third one is improve the mechanism of election supervision.
