Research On The Legal Risk Of Large-scaled Sport Event In China

With the national economic and social progress, in our overall strategy for sports development, especially in recent years, the strategic focus produced a change in the process of sports undertakings. The booming of sport industry which relying on sporting events and aiming at economic and social promotion ,stimulating national consumption and open up new economic growth point has become the hot and new topic of sports development strategy. Among them, the large scaled sports events with public welfare properties become the best choice of governments at all levels. Because driven by the rapid development of China's urbanization process governments wish to promote urban development and enhance the city image by the large scaled sports. At the same time, large-scale sporting events implied by the enormous social and economic value, also attract all levels of government, various businesses and social organization's interest and encourage their enthusiastic participation.The twenty-first century is a era of laws and economics. According to the law and regulations, to achieve the protection of rights and benefits of organized parties, sponsors, participants and spectators and attach importance on and legal risk prevention and management of sporting events are the objective needs of hosting major sports events that adapt to the changing market environment in China. To strengthen the legal risk prevention and management in large scaled sports event is also the most important guarantee for its reform and development.During the previous large-scaled sports events held in China , some of the legal issues and risks is short-termed,that can be sovled by temporary legislation and related special policy. But when the events ended, these related policies and laws'changes and development will lead to some new problems.The large-scaled sports events that will be held facing new legal issues and legal risks. How to avoid these legal risks, ensure lawful planning, standardized operation and success and to achieve economic and social benefits double harvest, these issues are very important and realistic. In the all links in the preparation and process of large-scaled sports events, no matter encounter what kind of risk factors, the results are eventually lead to legal risk. It not only brings reputation damage and interests losses, but also violate the rights and against the interests of athletes, coaches and the audience. Legal risks arising from these events will eventually lead to related main body bear the corresponding legal responsibility. Therefore, analysis of legal risk, legal risk prevention and control of major sports events on the success it is very important.Based on the analysis of data and literature resources, this study believe that in the background of Beijing Olympic Games and under the sports rule by law environment, take major sporting events corresponding legal risk technology and achievements as a reference to study the large-scale sporting events legal risk prevention and control in China has an important theoretical and practical significance. In order to achieve the research objectives, this study use the means of major sports events target value theory, stakeholder theory, logic theory and so on. In order to do much deeper analyze and research, based on the knowledge of legal theory this paper try to analyze from the perspective of organizing, operation and management rules and its requirements of sports events.The resuts are as follows:(1) Large-scale sports events legal risk in China refers to sports-related risks within the jurisdiction and the legal system, the law is clear, but the events related to the individuals and legal persons who violate the law and principles.The dispute lead to legal proceedings or punish by regulatory body thus negatively affect the operation of large-scaled sports events. And can not meet changes due to external legal environment, or the law is not perfect lead to the low effectiveness of execution. This affecting the normal operation of large-scaled sport events, or weaken its competitive ability, survival ability. The possibility of negative legal consequences caused by the above situation.(2) Based on the current state of the large-scaled sports events and its legal risk environment, summed up the features legal risks of larged-scaled sports events in China: objectivity, relativity, potentiality, complexity, variability and expansibility. From the analysis of the large-scaled sports events, start from the existed legal risks, this paper introduce the main types of legal risk in detail.(3) Based on the analysis of legal risk of large-scaled sports events in China,this papwer study the legal risk prevention and control. That is by means of sound relevant laws and policies, raise awareness of risk prevention, foster high-quality sports legal talent, introduce legal services to prevent legal risks. And through the establishment of an independent legal personality in the tournament organizing committee, start legal risk contingency plans and coordination of various departments in a timely manner to carry out masures to avoid legal risk.
