A Research On Urban Community Autonomy Under Nomocracy Perspective

With the in-depth reform of economy and society,nowadays our social structure has changed greatly.Meanwhile,the traditional social control system gradually begin to highlight its limitations.Therefore social management innovation as a brand-new proposition begin to enter the horizons range of the people.When it comes to the concept of community autonomy,we should realize that it means the community residents may in abide by law and community autonomy under the premise of articles by self-management,self-education,self service and self-supervision to handle their own affairs.This article believed that community autonomy should be consist of personnel autonomy,financial autonomy,service autonomy,management autonomy and education autonomy.Facing up with the present in th plight of community autonomy,the solution is to further define the modern commodity subdistrict by owners' committee gradually replacing the residents committees in their functions and become the leading bodies.This paper argues that the ideal community autonomy model can be summarized as "five items,four rights,two elected,one hired and three issued".Just as the legal proverbs says,no remedy no rights.The relief of community autonomy should include three aspects:firstly,we should revise the procedure of recall of Owners'Committee members to lower the threshold recorded by the Regulations on Realty Management;secondly,we should expand the scope of accepting cases of administrative proceedings to put administrative instruction under the judicial review;thirdly,we should change party general branch in community into arbitration agency which special deal with community election disputes.Unde this kind of pattern,community autonomy will move away from the circle of over-administration.Then the community members will be able to participate in the constrution of democracy at the grass-roots level.At that time,the construction of Chinese Characteristic Democratic Political Socialism will come true,meanwhile,citizens will truly achieve their rights to know,to participate,to express and to supervise.What's more,the superority of socialism will be release more gorgeous light.
