Studies About College Legal Construction

Realizing Socialism Legal System is a big and a hard cause. It's a combination of law making, law undertaking, law supervision and legal education. It aims at consummating Socialism Legal System, deepen governing the country according to law. As we are experiencing a highly boomed economy and highly reputed international status, there must be a soon-coming reform in education scope. College students are the future hosts and hostess of China, so their legal consciousness means a lot for all aspects of China. Universities and Colleges should take a shoulder of training this kind of new men without any doubts. Nowadays, Socialism Legal Construction are on State's strategy, as we experienced good results laid in past decades, we must look forward to perfect this grand and lofty cause.As a major part of Elite Social System, colleges face many multiple and complex issues about inner and outer legal relations, such as relations between college and government, society, students and teachers. These complete the main stream of College Legal Relations. Consummate college legal construction may promote innovations about education departments, protect all aspects of legal rights, and solve new coming challenges in new times.In this essay, we would like to prefer college as independent judicial person. System reformation about higher education has been very difficult to analyze or study from traditional viewpoints, because concepts always update with time.Education right lives as a fundamental part of human rights has been widely accepted. While in our daily life many education rights still were infringed, such as change students'future wills without permission, cancel one's status as a student just because a cheat or fault, corporal punishment etc. In a trend of more and more democratic, students desire more dignity and justice, even objective judges in scholarship, honor conferred, and employment areas. However college administrations often break procedure, infringe rights, and work without justice. So we'd better use public laws to regulate these kinds of issues.In reality, teachers are weak parts related to college administration, even though they are professional faculties according to Teacher's Law. Teachers are not civil public servants or subordinates of college, they are relatively independent personality. It seems there is a contract between a teacher and college, indeed almost all import parts are governed or regulated by college administration. We'd better define it as administrative legal relation about college and teachers, together with administrative law and procedure law, so as to regulate this scope more reasonably.In history, college used to be subordinate of government. But as we experienced market economy revolution, college became a judicial person according to Education Law, and reconstruct rights, obligations and responsibilities between college and government. The author believe, relations between college and government are very complicated, because most college as hosted by government. Intimate relations of these two exist in administration and property rights. I believe this is the reason for nowadays. So I hope one day, college will not be so administrative but more legal from all aspects.This Paper focuses on College Legal System construction. By analyzing inner and outer legal relationships of College Legal System, learning advanced skills of western countries, the author is trying the best to find a way for College Legal System construction and hope this paper will do some benefit for my own college.
