Environment and development are the theme which is concerned with by the international community. At present, preventting pollution and protectting the environment are challenges faced by humanity. At present, China has entered a new stage of environmental protection of the optimization of economic development to protect the environment. Environmental protection in a basin has become an effective option to achieve a long-term economic and sustainable development. In this context, improvement on legal system for ecological compensation on water environment in a basin in China is studied in the article.The article aims to improve the ecological compensation laws and regulations and establish legal system for ecological compensation on water environment in a basin. Firstly, it aims to improve the system of policies and regulations on ecological compensation. Secondly, it aims to improve the environmental policy system. Thirdly, it aims to achieve the change the end of treatment from the changes to the source control on water and environmental protection.In fact, drawing on the research results and practical experience at home and broad, the article stadied the legal system for ecological compensation on water environment in a basin.The article collects data on ecological compensation and uses literature and a typical carding analysis to find the current situation of domestic and international water environment research ecological compensationAfter analysing the current situation, the article comes to the main problems for ecological Compensation water environmentin China. In this paper, the relevant domestic and international ecological compensation data and typical examples are used to find many factors,which restricts the improvement on legal system for ecological compensation on water environment in a basin in China.The article proposes some specific recommendations on improvement on legal system for ecological compensation on water environment in a basin, such as implementation of ecological compensation for water environment protection measures and improvement for the water environment of ecological compensation system. Firstly, the article defines some concept, a basin, ecological compensation and so on. The article also clarifys the basic concepts. Meanwhile, the article rationalizes the legal relationship for ecological compensation on water environment in a basin and clear the basic laws governing factors in ecological compensation matters. The article points out the nature of legal system for ecological compensation on water environment in a basin, analyzes the necessity of the ecological compensation,and explains the theoretical and practical basis on ecological compensation on water environment in a basin.Secondly, the article describes legislation ecological compensation on the water environment at home and abroad, and introduces some ecological compensation legislation in foreign countries. The water environment at home and abroad ecological compensation status of legislation were reviewed, and China's ecological compensation in the legislation referring to foreign advanced experience is noted. Thirdly, the article points out the shortcomings and constraints of ecological compensation on water environment in China,such as the lower level of environment legislation, unreasonable guiding principle of ecological compensation, the lack of perfective management system and organization, lack of water and long-term mechanisms.Finally, the article presents some suggestions on improvement the system of policies and regulations on ecological compensation in a basin in China. These suggestions mainly includes the following aspects. Firstly, the legal relationship for ecological compensation on water environment in a basin should be cleared. The subject, object and content of the legal relationship for ecological compensation should be cleared.Secondly, laws and regulations for ecological compensation on water environment in a basin should be improved. The article presents suggestions on the principle of ecological compensation and on improvement management and ecological compensation in a basin in order to perfect the legal relationship on legal system for ecological compensation on water environment in a basin in China. Thirdly, the article presents measures to achieve for ecological compensation on water environment in a basin, a series of economic and technological measures included.Fourthly, establishing a public participation organization to provide a platform for public participation in the implementation of water environment is presented,which will be benefit to the principle of ecological compensation of public participation. Furthermore, the article also addresses relief measures of ecological compensation on water environment in a basin. The article points out that equal negotiation, arbitration, litigation and other means should be used to solve the water environment of ecological compensation experience of contradictions.Considering the reality of ecological compensation in China, the article analyzes the insufficient and looks for gaps to explore the way and approach to legal system for ecological compensation on water environment in a basin in China,which is benefit to the establishment of the legal system for ecological compensation on water environment in a basin in China.
