Study On The Perfection Of China's Product Liability Legislation

Product liability is an important issue of the economic society, it relates to the consumer protection, and the healthy development of national economy, therefore it was taking into account by many countries. Since World War II many countries in Europe and America has started the action of corresponding specific regulations. In China the legislation of product liability started late, until 1980s there have been developed a series of relevant laws and regulations, and there have not developed a single line of product liability law yet. This legislative system of China may lead to conflicting of legal provisions, and some issues of law applicable. Moreover our present legal provisions on product liability system is imperfect, it can not adapt to modern economic development. To promote with international standards, and promote the healthy development of China's economy, and protect the legitimate interests of consumers effectively, it is necessary to study the adoption of the law on product liability system.This paper study the legislation on product liability system, from theoretical and practical comprehensive hand, and examine the system's deficiencies,and referring to more mature foreign legal system, so as to puts forward some recommendations of the legislation system for China's product liability. This paper is studying from several aspects, just like the product liability legislation, the scope of products, the defined of product defects, the main product liability, responsibility principle, damages, and the provisions of foreign product liability. The paper point out some problems of China's product liability system, and study the foreign product liability legislation, to put forward some proposal for improving China's product liability system.
