Product Liability For Foreign Study

With the acceleration of global economic integration and the rapid development of science and technology, the associations between countries in the fields of international economy and trade has gradually become closer, the range of products is increasing, so is the complexity of products. Due to the inevitable product defects in the production process, international disputes about product liability damages are in growing trends, the law applicable to the problem has become more evident. Product Liability Law is a newly-developed legal department emerged after World Warâ…¡, in which field no matter in theory or in judicial practice China is developing at a speed lagging behind the United States and other developed countries, e.g. the protection of victims is not ideal enough and the punishment of those in charge is relatively weak Therefore, strengthening the study of the theory of Foreign Product Liability on compensation of damages, learning from foreign legislative experience, improving our product liability legislation are of great significance.This paper is to describe this topic from four aspects, the first part is about the Foreign Product Liability Law and its development; the second part is about the conflicts in relation to the Foreign Product Liability Laws, which majors in analyzing the reason for which the conflicts happen, introducing main aspects which reflects the conflicts, and also ways to settle them. The third part is about of the institution to which the Foreign Product Liability Law applies in some developed countries, which mainly involves the application principle of the law as well as the application institution in some developed countries; The fourth part is about the analysis of Substantive Law of Product Liability in our country along with some detailed legal cases, the current situation and defects of the law, on basis of which the author put forwards more advice for perfection.
