China And South Korea Between The Two Product Quality Responsibility System

With the flourishing economic development of our country, the increasingly diverse material products have met the people's material needs to a tremendous satisfaction, while fake and shoddy products are flooding the market for the sake of benefits which greatly harm the interests of consumers and by which lawsuits about the liability for the quality of products have been followed. Based on the basic theory of the Civil and Commercial Law,this paper has proposed some recommendations on improving the quality liability system of our products, using the thinking way of Marxist dialectical: general and special, personality and common, general and individual, after systematic and in-depth comparative study of the liability of product quality systems in both China and South Korea.The paper is divided into five chapters four of which are texts.The first chapter mainly deals with the general theory of liability of product quality systems that is the definition of liability of product quality, legal features, constitute elements and liability principle and so on. First, two confused definitions: product liability and product quality liability have been given a comparative analyses.Second, exposition of legal features, constitute elements of product quality liability. Last, focusing on the liability principles.The second chapter mainly introduces Chinese liability of product quality systems. Currently, there hasn't yet a complete law on liability of product quality. This chapter is about a general survey of the formation and development of Chinese liability of product quality systems, the definition of product, the range, the defect, the compensation for damage and reasons of exemption from responsibility.The third chapter is about a general survey of liability of product quality systems in South Korea, which is It is laid down in the"Product Liability Law". The context is about the formation and development of"Product Liability Law", the definition of product, the range, the defect, the compensation for damage and reasons of exemption from responsibility, and so on.The fourth chapter draws a comparison between China and South Korea in liability of product quality systems. By drawing on advanced Korean products liability regime theories, propose the recommendations on improving the quality liability system in our country in order to better adapt to the international and domestic situation of development and keep our quality liability system with the international trend.
