Study On The Probation System Of Chinese Juvenile Offenders

The juvenile offenders are the minors who committed crime under 18 years old, and violated the criminal law by the criminal prosecution and trial. Chinese juvenile offenders have the characteristics of committed crime as young, the low level of education, the large proportion of criminal gangs,a single criminal purpose and motivation, most of them are the first-time offenders, easily re-education and so on.The probation system of juvenile offenders which started in the United States has the characteristics of humanity,reasonable,economic,judicial practice in the practical results and so on, it was widely accepted by the world.Chinese probation system has the defects of no distinction between juvenile offenders and adult offenders ,the juvenile offenders probation inspection system is imperfect, Chinese current policy against juvenile criminal , and the other defects.In view of the situation and the characteristics of juvenile criminality and reference the juvenile offenders probation system of the other countries in the world , our criminal legislation and justice should be set up the juvenile offenders probation system which be different from adult probation system, deleloped the application of probation which meets the juvenile offenders,increased the procedural requirements and perfected the inspection system of the juvenile offenders.
