On the basis of analysis of theory and practice investigate, this passage studies each aspects of aleatory contract, and put forward assume to set the aleatory contract in civil code.The first chapter of this passage is summary of aleatory contract. In this chapter I study the aleatory contract as a whole first of all, introducing the concept, the nature and law character of aleatory contract, explaining the differentiate between aleatory contract and the contract with condition. Following that, I introduce the history of aleatory contract, and according to history of China and foreign countries, I study some kind of aleatory contract such as insurance, lottery, gambling and so on about their appearance, development and change of law statue. And I point new styles of aleatory contract along with the development of times.In the second chapter of this passage, I introduce some basic kinds of aleatory contract, including insurance, lottery, gambling, sale with award, guess with award and so on. In this passage I analyze their respective characters and common characters as aleatory contract, and analyze distinguish between legal aleatory contract and illegal lottery, pointing that in China, legal aleatory contract should process commonweal, service for social work, aleatory action with only gamble can't be legal and be ensured by law.In the third chapter of this passage I introduce legislation status about China and foreign countries, including Germany, France, Switzerland, Italy, Russia, Britain and America, and the regions of Macao, Taiwan. We can study those kinds of legislation and get revelation from them. In the second part I introduce legislation status about aleatory contract in China, including how to restrict aleatory contract such as insurance, lottery, gambling, sale with award, guess with award and so on, and the shortage in law about it.In the fourth chapter of this passage, there is condition about aleatory contract in China. Many aleatory actions have been at large in China, for example insurance, lottery, gambling, sale with award, guess with award and so on are common occurrence in life. But related law is absent now so that there is usually speculation. In this chapter I first analyze the status quo of aleatory contract in China, and quote data from "aleatory action investigate in Shandong Province" which is organized by me and supported by the law academy of Shandong University. I try to prove that aleatory contract need have the nature of service for social work so that it can be admitted by person. The implicit gamble of aleatory contract should be restricted rigidly. On the basis of analyzing status, I bring forward my opinion that there should be principle provision about aleatory contract in civil code, and regulate sequent of gambling. There should be expert lottery law, regulating particularly for lottery, and forbid strictly illegal lottery.
