Research On The Related Legal Problems Of TBT And China's Textile Trade

Right of making laws on regulating trade manifests country's sovereignty. But WTO supervises this right through TBT Agreement and other international treaties. For China's textile industry , export restricts such as quotes ,safeguards articles will invalid on Dec.11th 2014.TBT will be the most affective trade barrier as a result .Analyzing WTO TBT Agreement and Technical Laws, Technical Standards and Conformity Procedures Assessments of China's major textile trade partners',author offers a menu for coping with foreign textile TBT and perfecting TBT law system of China's own .Excluding preface and ending paragraph , this thesis consists of four parts .Part one introduces some basic law points of TBT such as concept, law resources and characteristics. Since there is no technical law concept in China's law system, the analyzing on technical laws and obligatory technical standards is done here for a clue to improve China's TBT law system. Part two introduces TBT's principles and executing mechanism, and then analyses and judges the advantages and weak points of TBT Agreement on the ground of international law theory and the practicing of international society .Part three focus on the detailed TBT law system of Euro and America in textile industry .The last part gives Anti-TBT measures for the subjects of government ,textile liaison organization and enterprises,and analyses the present situation and problems of our TBT law system .Finally author makes some suggestions for perfecting China's TBT law system on the basis of synthesizing the above analyses.
